Updates to IRA Charitable Rollovers

The recently enacted Emergency Economic Stabilization Act of 2008 includes a two-year extension of the IRA charitable rollover. The provision, originally enacted as part of the Pension Protection Act of 2006, permits IRA owners starting at age 701/2 to make tax-free charitable gifts totaling up to $100,000 per year from their IRAs directly to eligible charities such as The Long Bay Symphony. For married couples where each spouse has an IRA, each can transfer up to $100,000 as long as they meet all qualifications. The provision expires Dec. 31, 2009

Qualified distributions must be made directly to the Symphony by the plan trustee. Contact your plan trustee for information on how to initiate a transfer. This "qualified charitable distribution" is excluded from the donor's adjusted gross income.

Eligible IRA owners or the IRA beneficiaries can take advantage of this provision, regardless of whether they itemize their deductions. Only outright gifts are eligible. Distributions to charitable gift annuities, charitable remainder trusts, pooled income funds and other split-interest arrangements do not qualify.

As with all charitable gifts, consult your legal, tax or financial advisor before making a decision to employ this giving option.
